The Amanda Project (“TAP”) has created this privacy policy statement in order to demonstrate our firm commitment to your privacy. We are committed to providing a fun, entertaining, and safe Web site for all our users.  Likewise, we are dedicated to safeguarding any personal information collected on the TAP Web site. The following discloses our practices regarding information collection and use solely for the Web sites located at www.theamandaproject.com.

By using or accessing TAP, you signify your agreement to be bound by our Privacy Policy. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY YOU MAY NOT ACCESS OR OTHERWISE USE TAP. 

Personally Identifiable Information

We do not collect personally identifiable information from you unless you voluntarily provide it to us.  In order to register as a member of TAP, and in connection with your use of TAP, we may ask you to provide us, or you may choose to upload, personal data including first and last name, e-mail address, birthdate/age, physical address, and other information ("Personal Information").

Aggregate Information

In addition, we may also collect non-personally identifiable information, such as IP host address, Web pages viewed, browser type, demographic data and other data, and may aggregate any information collected in a manner which does not identify any individual ("Aggregate Information").

Information Usage

We may use your Personal Information to send out news, contests, and offers - including from third party marketers - to your e-mail address, to enforce our Terms of Use, or to ensure compliance with COPPA requirements (as addressed below).

We will never sell your Personal Information to any third party not affiliated with us without your consent, except in connection with the sale or merger of our company or the division responsible for providing you with the services you use. 

TAP does rely on other companies in order to carry out various tasks such as technical services for our Web site, marketing, etc. These companies can in certain cases gain access to Personal Information which they need in order to complete an assignment for TAP.  All such third parties are instructed that they can only use your data in order to complete the assignment for TAP, and for no other purpose.

Please note that we reserve the right to access and/or disclose Personal Information we gather as required by law or to the extent necessary for us to investigate suspected fraud, harassment, or other violations of any law, rule, or regulation, or the TAP rules or policies. 

Aggregate Information may be shared with any number of parties, provided that such information shall not specifically identify any individuals.

"Cookies" are pieces of information that may be placed on your computer by a Web site for the purpose of facilitating and enhancing your communication and interaction with that Web site. We have put in place reasonable physical, electronic, and managerial procedures to safeguard the information we collect. Only those personnel who need access to your information in order to perform their duties are authorized to have access to your Personal Information.

You should be aware that Personal Information which you voluntarily include and transmit online in a posting may be viewed and used by others. For this reason, most Personal Information is prohibited from being posted on TAP under our Terms of Use; however we are unable to control all such uses of your Personal Information, and by using such services you assume the risk that the Personal Information provided by you may be viewed and used by third parties.

Protection for Children

We ensure that our Privacy Policy and our information practices adhere to the United States Children's Online Privacy Protection Act.

If a user under the age of 13 attempts to register, the account will automatically be flagged as a pending and limited membership account and we will inform the child that parental consent is required to activate a full membership account. Depending on the level of activity the child wishes to obtain, a parent's consent is required by accepting our “Notice to Parents” e-mail.  A more detailed description of the level of activities is presented in the “Notice to Parents” e-mail that parents receive from us. Until this level of verifiable parental consent is obtained, the child will only have access to certain features of the site and have limited access to TAP.

TAP uses both technical filters and moderators who supervise what happens on TAP in order to offer a nice and safe environment. The moderators also answer members' reports of unpleasant and unsuitable behavior but we still urge all parents to be actively involved in following their children's activity on the Internet.  However, we cannot block all conversations and materials containing objectionable content on TAP.

As a convenience to you, we provide links to third-party Web sites from within TAP.  Some sites include: The iTunes Music Store, Amazon.com, CafePress.com, and others.  TAP accepts no liability on the part of, nor makes any endorsement of these third party Web sites or their services.  Likewise, we are not responsible for the privacy practices or content of these third-party sites.  

Communications with us

By providing your e-mail address to us, you expressly consent to receive e-mails from us. We may use e-mail to communicate with you, to send information that you have requested, or to send information about other products or services developed or provided by us, provided that, we will not give your e-mail address to another party to promote their products or services directly to you without your prior consent.

Subject to the Terms of Use, any communication or material you transmit to us by e-mail or otherwise, including any data, questions, comments, suggestions, or the like is, and will be treated as, nonconfidential and nonproprietary. Furthermore, you expressly agree that we are free to use any ideas, concepts, know-how, or techniques contained in any communication you send to us without compensation and for any purpose whatsoever, including but not limited to, developing, manufacturing, and marketing products and services using such information.

Changes to Policy; Opt-Out Process

We reserve the right, at our discretion, to change, modify, add, or remove portions from this policy at any time. However, if at any time in the future we plan to use Personal Information in a way that differs from this policy, we will post such changes here and provide you the opportunity to opt-out of such differing uses. Your continued use of TAP following the posting of any changes to this policy means you accept such changes.

We are not responsible for removing your Personal Information from the lists of any third party who has previously been provided your information in accordance with this policy, such as a business partner.
